The general terms and conditions
1. General
1.1. These general terms and conditions apply to all agreements between Talenschool Nick Daniels (hereinafter referred to as “Talenschool Nick Daniels”) and its customers (hereinafter referred to as “students”).
1.2. By registering for a course or lesson at Talenschool Nick Daniels, the student agrees to these terms and conditions.
2. Registration and Payment
2.1. Registration for courses takes place via the online registration form on the website or by email.
2.2. After registration, the student will receive a confirmation and invoice. Registration is finalized once payment has been made.
2.3. Payment must be made in full before the first lesson, unless otherwise agreed.
2.4. Payment term and collection costs
2.4.1. Payment must be made within the period stated on the invoice. The standard payment term is 14 days from the invoice date, unless otherwise agreed in writing.
2.4.2. If payment is not received within the stipulated period, the course participant will receive a payment reminder without additional costs.
2.4.3. If no payment is received after 14 days after the reminder, a penalty will be charged in the form of statutory collection costs according to the Collection Costs Act (WIK):
- 15% on the outstanding amount up to €2,500, with a minimum of €40.
- 10% over the amount from €2,500 to €5,000.
- 5% over the amount above €5,000.
The maximum collection costs are €6,775.
2.4.4. If payment remains unpaid 28 days after the original due date, an additional penalty will be calculated based on the same percentages over the total outstanding amount including previous collection costs.
2.4.5. After 42 days from the due date, Talenschool Nick Daniels reserves the right to hand over the debt to a collection agency. The costs of the collection procedure shall be borne entirely by the course participant.
2.4.6. All additional costs, including legal costs, arising from the late payment by the course participant shall also be borne by the course participant.
2.4.7. In case of disputes regarding payments, please refer to Article 9.

3. Cancellation and Changes
3.1. Cancellation by the student must be submitted in writing via email.
3.2. If canceled within 14 days after payment for the course, no fees will be charged, provided no lessons have been attended. If lessons have been attended, these will be deducted from the refund amount. Free lessons are placed at the back of the lesson cycle at all times. After this 14-day period, no refund will be given.
3.3. Talenschool Nick Daniels reserves the right to cancel or reschedule a course due to insufficient participants or unforeseen circumstances. In this case, the student will receive a full refund.
3.4. Blooket's games expire to 1 year, as the games have a maximum duration of 1 year. Gimkit's games expire after 3 months. Should the student have longer access, this request may be reported to info@talenschool-nickdaniels.com.
3.5. Upon deregistration or leaving the course, access to the reading and listening lists will also expire. These are removed from the personal program because these lists are an extra service for students who following classes. When the student takes another lesson package, the list will be reinstated. ​
3.6. Specific cancellation for fixed-term courses
- For courses with a fixed duration of 9 months, the course participant is obliged to pay the tuition fee for the full duration of 9 months. However, they may cancel up to 14 days on the same condition as in article 3.2
- For courses with a shorter duration, the regular cancellation period as described in article 3.2 applies.
- Course participants can choose to buy off the remaining tuition fees in one go by paying a commutation fee. This commutation fee is calculated on the basis of the remaining months and determined in writing in advance.

4. Course Materials and Intellectual Property
4.1. Course materials provided by Talenschool Nick Daniels remain the property of Talenschool Nick Daniels and may not be copied or distributed without permission.
4.2. The use of course materials is intended for personal use by the student only.
4.3. Lessons are recorded. These recordings serve as proof of the student’s attendance and allow the student to review the lessons as an additional service.
4.4. Students are not permitted to make their own recordings during lessons without prior permission from the instructor.
5. Liability
5.1. Talenschool Nick Daniels is not responsible for any damage, loss, or theft of personal belongings of students during lessons or events organized by the school.
5.2. Talenschool Nick Daniels is not liable for any direct or indirect damages arising from the use of materials or advice provided by the school.
5.3. In the event that Talenschool Nick Daniels is held liable, liability will be limited to the amount paid for the course.
6. Lesson Scheduling and Attendance
6.1. Lessons are scheduled by the student through the website. If the available times are not suitable, the student may contact the school by email. If no suitable dates can be found, the student will be refunded for unused lessons. The final lessons of a course are not refundable as they are provided for free.
6.2. If a student is unable to attend a lesson, this must be communicated at least 72 hours in advance. If canceled too late, the lesson will be forfeited without a refund.
6.3. Talenschool Nick Daniels reserves the right to reschedule or cancel a lesson due to unforeseen circumstances. The student will be notified in time and will receive a refund or credits on the same way they paid for it.

7. Course Duration and Progress
7.1. Each course has a set duration, which is communicated during registration.
7.2. Talenschool Nick Daniels offers regular evaluation moments to assess the student’s progress.
8. Privacy Policy
8.1. Talenschool Nick Daniels respects the privacy of all students and ensures that personal data is treated confidentially.
8.2. Personal data will only be used for administrative purposes and to inform the student about relevant matters concerning the course.
9. Governing Law and Disputes
9.1. All agreements between Talenschool Nick Daniels and the student are governed by Dutch law.
9.2. Disputes arising from the agreement will preferably be resolved through mutual consultation. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
